What will be the correct structure of tetra chloro cuprate (2) ion

Sir, In the note there are 2 possible structures are mentioned for the same complex. i.e. tetra chloro cuprate (2) ion. So what will be correct one?

    In coordination number 4 only those Metal ion which has d8 or d9 configuration can form either square planar or tetrahedral geometry while rest d- configuration form tetrahedral geometry (with some exceptions (Co(CN)4) 2- which has reason.) Cu2+ is d9 configuration and cl- is a weak ligand so definitely it will form tetrahedral complexes. Strong ligand form square planar complexes as it has very high cfse which compensate the hybridization energy.
